Upon confirmation of the offer and/or confirmation of the consultation appointment, the following contractual conditions are agreed between the parties:
The contracting party books a fee-based consultation appointment or requests the issuance of a U.S. visa for one or more applicants of his/her company or for him/herself in order to enable a temporary stay of the applicant(s) in the USA.
The US Visa Service will provide the Contracting Party and the applicant with advice and support.
Thesis General terms and conditions (GTC) apply to all online via the "US Visa Portal" for booking consultation appointments and services in connection with US visa applications.
By making a booking via the portal, customer a binding offer to conclude a contract. The contract is concluded by our electronic confirmation. The GTC are displayed before the order process is completed and must be actively confirmed.
The services include advice and support with the application for US visas. There is expressly no guarantee of success with regard to the granting of a visa.
The US Visa Service will assist the applicant with the entire application process and handle the application in accordance with the current legal requirements of the US authorities. Depending on the jurisdiction, the application will be submitted at the following facilities in the USA:
The US Visa Service is not responsible for issuing the following US visas, as the decision to issue a US visa is made by the US authorities (US consulate / US embassy / US immigration authorities). The US Visa Service relies on the cooperation of the contractual partner and the applicant for the advisory and support services, which they hereby undertake to provide.
The US Visa Service has no influence whatsoever on the technical availability of the electronic application form DS-160 or the availability of interview appointments at the US consulate or embassy. The US Visa Service is expressly not liable for technical problems or scheduling bottlenecks on the part of the US authorities.
Duty to cooperate
The customer undertakes to provide all information necessary for the proper provision of the service completely and truthfully.
The prices stated on the US Visa Portal include the applicable statutory value added tax. All services are fixed prices and apply to the visa services described there.
In addition to the fees for our service, there are also third-party fees charged by the US authorities, which may vary depending on the visa category. These are included in the final price.<
Payment is made exclusively in advance via the payment methods offered in the booking process (e.g. credit card, PayPal or instant bank transfer). The application will only be processed once payment has been received in full.
If an invoice with a separate company name is required, the customer undertakes to provide all necessary data completely and correctly during the booking process (e.g. company name, address, cost center, contact person).
Cancellation of the booking is only possible before the start of the service. After the start of processing (e.g. by checking documents or contacting us), a refund is excluded. If the cancellation is made in good time, we will refund 50% of the amount paid as a lump sum. Cancellation free of charge is only possible if the service has not yet begun and no invoice has been issued.
Consumers have a 14-day right of withdrawal. Detailed revocation instructions including a sample revocation form are here available.
Important note on the premature expiry of the right of withdrawal:
If you request that we start providing the service before the expiry of the withdrawal period and we have already started processing your visa application (e.g. by evaluating documents or recording your data), your right of withdrawal will expire prematurely if you have expressly agreed to this at the time of purchase.
Chargeable consultation appointments can be canceled free of charge up to 3 pm. the day before at the latest. No refunds are possible after this time. Further details on cancelation are listed in the booking system.
Confidential information within the meaning of this agreement is
(1) All oral or written information and materials which the US Visa Service receives directly or indirectly from the Contractual Partner for the purpose of processing the order and which are marked as confidential or whose confidentiality arises from their subject matter or other circumstances.
(2) The commissioned services and other work results. The US Visa Service undertakes to treat all confidential information of which it gains direct or indirect knowledge as strictly confidential and not to pass it on to third parties, exploit it or use it without the prior written consent of the contractual partner. The US Visa Service will take all appropriate precautions to ensure confidentiality. Confidential information will only be passed on to employees or other third parties who must receive it due to their work. The obligation to maintain absolute confidentiality continues even after the end of the cooperation. Upon request, any documents handed over, including all copies made thereof as well as working documents and materials, must be returned or destroyed and disposed of by the US Visa Service in accordance with its own data protection guidelines.
Liability for slightly negligent breaches of duty is excluded, except in the case of damage resulting from injury to life, limb or health or material contractual obligations.

German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of fulfillment and jurisdiction is Berlin, provided the customer is a merchant.
